Welcome to Bridally.co.za (“Bridally”, “we”, “us” or “our”).
These Terms of Service (“Terms”) govern your use of the Bridally website, online store and all products and services made available through it.
By accessing Bridally.co.za, creating an account, placing an order, downloading a product or otherwise using our website, you agree to these Terms.
If you do not agree to these Terms, please do not use the website or purchase our products.
1. ABOUT BRIDALLY
Bridally is an online wedding-planning brand offering digital products designed to help couples plan, organise and manage their weddings.

All products offered through Bridally.co.za are subject to these Terms unless separate terms are provided for a particular product.
2. DEFINITIONS
For purposes of these Terms:
“Bridally”, “we”, “us” or “our” means the business operating Bridally.co.za.
“Customer”, “you” or “your” means the person purchasing or using a Bridally product.
“Digital Product” means any downloadable, electronic, digital or online product sold or provided by Bridally.
“Website” means Bridally.co.za and any associated Bridally webpages, checkout pages or digital product delivery systems.
“Order” means an order placed by you to purchase a Digital Product.
“Personal Use” means use by the individual purchaser for their own wedding or personal wedding-planning purposes.

4. DIGITAL PRODUCTS
All products sold by Bridally are digital unless expressly stated otherwise.
Digital Products may be supplied in formats including:

Google Sheets;
-
Google Docs;
-
ZIP files;
-
images;
-
spreadsheets;

downloadable documents; or
-
other digital formats.

You are responsible for checking the product description, format, compatibility and requirements before purchasing.
5. PRODUCT DESCRIPTIONS
We make reasonable efforts to ensure that product descriptions, images, previews and other information on the Website are accurate.
However, because Digital Products may be displayed differently depending on your device, screen, software, printer or application, we cannot guarantee that colours, fonts, formatting or other visual elements will appear exactly as shown in product previews.
Product previews may contain examples, mock-ups or watermarks and may not represent the exact final file.
6. ORDERS
When you place an Order, you are making an offer to purchase the selected Digital Product.
An Order is subject to acceptance and successful payment.
We reserve the right to refuse or cancel an Order where reasonably necessary, including where:

a product was incorrectly listed;

there has been a technical or pricing error;

we reasonably suspect fraudulent activity; or

the product is unavailable.
If we cancel an Order after you have paid, we will provide any refund required by applicable law.
7. PRICES
All prices displayed on Bridally.co.za will be stated in South African Rand unless otherwise indicated.
Where applicable, prices will include VAT or other taxes required by law.
Any applicable payment-processing charges or additional costs will be disclosed before checkout where required.
We reserve the right to change prices at any time.
A price change will not affect an Order that has already been accepted and paid for, except where an Order is cancelled because of an obvious pricing or technical error.
8. PAYMENT
Payment must be completed using the payment methods made available at checkout.
You authorise the relevant payment provider to process the amount displayed at checkout.
Bridally does not store full payment-card information where payment processing is handled by an independent payment provider.
Payment information may be processed by third-party payment providers in accordance with their own terms and privacy policies.
9. DIGITAL DELIVERY
After successful payment, your Digital Product may be delivered by:

email;
-
a customer account;
-
a download link;
-
a third-party digital delivery service; or
-
another electronic delivery method specified at checkout.
You are responsible for providing a valid email address where email delivery is used.
You should download and securely store your purchased files after receiving them.
Bridally is not responsible for a customer's inability to access a product due to:

an incorrect email address supplied by the customer;
-
an unsupported device;
-
incompatible software;
-
insufficient storage;
-
internet connectivity problems;
-
the customer's failure to download or save the product; or
-
changes to third-party software or platforms.

10. DIGITAL PRODUCT ACCESS
Unless otherwise stated on the product page, Digital Products are licensed to you for personal use and are not sold to you with ownership of Bridally's underlying intellectual property.
A purchase gives you a limited licence to use the purchased Digital Product in accordance with these Terms.
You may not share your download link or purchased files publicly or with people who have not purchased the relevant product.
11. PERSONAL USE LICENCE
Unless a product specifically states otherwise, you may:

Download the purchased product;

Save a copy for your personal records;

Print copies for your own wedding;
-
Fill in, edit or customise the product for your own wedding;

Make reasonable personal-use copies; and
-
Use the completed planner or template for your own wedding-planning purposes.
You may not:

Resell the Digital Product;
-
Give the original editable file to another person;
-
Upload the product to a public website;
-
Share the product in Facebook groups, WhatsApp groups, Telegram groups or similar communities;
-
Upload the product to file-sharing websites;
-
Sell completed or substantially copied versions of the product;
-
Use the product to create competing commercial products;
-
Claim the product or its underlying design as your own;
-
Remove copyright or ownership notices where applicable; or
-
Distribute the product for free or for payment.
12. CANVA AND THIRD-PARTY PLATFORM PRODUCTS
Some Bridally products may be designed for use with third-party platforms such as Canva, Google Workspace, Microsoft Office or other software.
Where a product requires a third-party platform, you may need your own account with that platform.
Bridally does not own or control third-party platforms.
We do not guarantee that third-party platforms will:

remain available;
-
maintain the same features;
-
support a particular file format;
-
maintain compatibility; or
-
remain free of charge.
Your use of third-party platforms is subject to their respective terms and policies.
Where a Bridally product contains third-party elements, fonts, graphics, photographs or other licensed material, your use may also be subject to the applicable licence restrictions.
13. INTELLECTUAL PROPERTY
All intellectual property rights in Bridally's original Digital Products, Website, branding, designs, graphics, text, layouts, templates and other materials remain the property of Bridally or our licensors unless expressly stated otherwise.
Your purchase does not transfer ownership of Bridally's copyright or other intellectual property to you.
You receive only the licence expressly granted by these Terms.
Bridally reserves all rights not expressly granted.
14. COPYRIGHT
You may not reproduce, distribute, publish, commercially exploit or create derivative products from Bridally's Digital Products except where expressly permitted by these Terms or by applicable law.
Unauthorised sharing, resale or redistribution may constitute copyright infringement.
If you believe that content on the Website infringes your intellectual property rights, please contact us with sufficient information for us to investigate the matter.
15. REFUNDS AND CANCELLATIONS
Because our products are digital, refunds and cancellations may be subject to specific rules applicable to electronic transactions and digital products.
Nothing in these Terms is intended to remove or restrict any consumer right that cannot lawfully be excluded.
Where applicable law gives you a cancellation, cooling-off, refund or other statutory right, that right remains unaffected.

If a product is defective, materially different from its description, inaccessible due to a problem caused by Bridally, or otherwise gives rise to a remedy under applicable law, please contact us so that we can investigate and provide the appropriate remedy.
We may, at our discretion and subject to applicable law, offer refunds or replacements in circumstances beyond our legal obligations.
16. TECHNICAL PROBLEMS
If you cannot access or download a purchased product because of a technical problem caused by Bridally, please contact us.
We will make reasonable efforts to:

provide another download link;

provide a replacement file; or
-
provide another appropriate remedy.
Before contacting us, please check your spam or junk folder and ensure that you are using the email address associated with your Order.
17. NO GUARANTEE OF RESULTS
Our Digital Products are planning tools and resources.
They are not a guarantee that your wedding will:

remain within a particular budget;
-
occur according to a particular schedule;
-
meet a particular planning objective; or
-
have any particular outcome.
Wedding costs, supplier prices, availability and other circumstances can change.
You remain responsible for making your own decisions and verifying information relevant to your wedding.
18. THIRD-PARTY INFORMATION
Some templates or planners may contain examples, suggested budgets, timelines, calculations, recommendations or other informational content.
Such information is provided for general planning purposes only.
You should independently verify:

venue requirements;
-
legal requirements;

marriage requirements;
-
payment obligations;

deadlines;
-
travel requirements; and

any other information that may affect your wedding.

19. WEBSITE CONTENT
We may update, change, remove or add Website content and Digital Products from time to time.
We do not guarantee that every product will remain available indefinitely.
If you have purchased a product, we will use reasonable efforts to maintain access to that product for a reasonable period, subject to the nature of the product and any specific access terms displayed at purchase.
20. PERSONAL INFORMATION AND POPIA
Bridally respects your privacy.

33. SEVERABILITY
